According to a report published by Ski Area Management magazine, the proposed Cherry Peak ski resort in Richmond, UT is facing a legal challenge from  a group of concerned citizens.

UPDATE: Park City Mountain Resort to Remain Open for 2012-2013 Ski Season

The ongoing land dispute between Talisker Mountain, Inc. (owner of Canyons resort) and Park City Mountain Resort has a new chapter. Talisker has pledged not to shut down operations at PCMR  for the 2012-2013 season. (For a refresher on the underlying claims click here).

Ski, Esq. Updates Less Frequent During the Off-Season



Just a quick note to our loyal readers. As many of you have noticed, things slow down on the site a little bit during the off-season. With resorts shuttered for the summer or focused on non-skiing activities, there's just less to talk about on the ski law front. Expect our commentary to pick back up again as winter approaches. In the meantime, where revelant stories develop, we'll keep you posted.

Ski, Esq. readers may recall a story we published two weeks ago discussing an Indian judge's ruling which will permit the development of a large, posh ski resort in the Himalayas to proceed. In the wake of the decision new details are emerging about just how much the delay has cost the local government.

Ski, Esq. notes a thoughtful piece in Pique magazine penned by Bob Barnett. Barnett, discussing the recent bankruptcy filing by Mammoth Lakes discussed by Ski, Esq. on Tuesday, posits that the resort village of Whistler, BC experienced similar problems and only narrowly avoided bankruptcy some 30 years ago during a similar economic downturn.

UPDATE: Town of Mammoth Lakes to File Bankruptcy Petition

In April, Ski, Esq. ran an article about the possible bankruptcy of the town of Mammoth Lakes, CA.  We reported:

"The town of Mammoth Lakes (CA) - home of Mammoth Mountain - is headed towards bankruptcy. It seems the trouble began back in 1997 when the town made a deal with a developer (Mammoth Lakes Land Acquisition - "MLLA") in which the town agreed to permit the developer to make improvements to the local airport (Mammoth Yosemite: MMH) in exchange for the development rights to a nearby property. Difficulties ensued when the FAA raised concerns about the town's proposed improvements and the town subsequently abandoned expansion plans. The developer sued the municipality for breach of  contract and won a $30M judgment, which with interest now stands at $43M."

Yesterday, the town council, unable to negotiate a settlement with its judgment creditor, unanimously approved a resolution to seek Chapter 9 bankruptcy protection.
